Terms of Service

1. Acceptance of Terms

By creating an account or using BrandNav (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free trial users and paid subscribers.

2. Description of Service

BrandNav is a brand AI visibility platform that monitors how brands appear in AI model responses (including ChatGPT, Perplexity, and Claude), analyzes citation patterns, and generates content recommendations to improve AI visibility. The Service is provided on an “as-is” basis and is subject to change.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access at hello@brandnav.ai. One account per person or organization unless otherwise agreed.

4. Permitted Use

You may use the Service for lawful business purposes to monitor and improve your brand's visibility in AI systems. You may not:

• Use the Service to monitor brands you do not have permission to represent
• Attempt to reverse-engineer or scrape the Service
• Use the Service to generate or distribute spam or misleading content
• Resell or sublicense access to the Service without written permission
• Attempt to circumvent rate limits or usage restrictions
• Request, prompt, or attempt to generate images, videos, audio files, music, animations, artwork, or any non-text media through the Service. BrandNav is a text-based content strategy platform only.

5. AI-Generated Content

The Service uses third-party AI APIs (including Anthropic, OpenAI, Google, and Perplexity) to generate content recommendations, briefs, and analysis. AI-generated content is provided for informational purposes only. You are responsible for reviewing, editing, and verifying any AI-generated content before publishing or acting on it.

6. Subscription and Billing

Paid plans are billed on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with 30 days' notice. Free trial users may be converted to paid plans or have access revoked at the end of the trial period.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We store query results, brand data, and account information on Google Cloud infrastructure. We do not sell your data to third parties.

8. Intellectual Property

You retain ownership of your brand data and content you submit. By using the Service, you grant us a limited license to process your data to provide the Service. The BrandNav platform, code, and branding are owned by Third Coast Data LLC and may not be copied or reproduced without permission.

9. Limitation of Liability

To the maximum extent permitted by law, BrandNav and Third Coast Data LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including lost profits, lost data, or business interruption. Our total liability for any claim shall not exceed the amount you paid in the 12 months prior to the claim.

10. Disclaimer of Warranties

The Service is provided “as is” without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated recommendations will improve your brand's performance in any specific way.

11. Termination

We may suspend or terminate your account if you violate these Terms, abuse the Service, or fail to pay. You may terminate your account at any time by contacting us. Upon termination, your data will be retained for 30 days before deletion.

12. Governing Law

These Terms are governed by the laws of the State of Illinois, United States. Any disputes shall be resolved in the courts of Cook County, Illinois.

13. Changes to Terms

We may update these Terms at any time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Service after changes constitutes acceptance.
